• Joint Resolution No. 2945 between the City of Muskogee (COM) and the Muskogee Redevelopment Authority (MRA), providing for the transfer of Economic Development operations management and funds, as well as, for the transfer of the Civic Center operations management and Enterprise Fund, from the MRA to the COM.

• Resolution No. 2946 amending the Bylaws of the Muskogee Redevelopment Authority.

• Letter from the City Manager of the City of Muskogee terminating the contract executed on November 8, 2021, between the City of Muskogee (COM) and the Muskogee Redevelopment Authority (MRA), which transferred supervision of the Economic Development Program and funds from the COM to the MRA, additionally waiving the ninety (90) days’ notice requirement for immediate termination of the contract, or take other necessary action.

• City Manager to negotiate and execute an agreement with Tiger Natural Gas as a third-party provider for gas utility services for the City of Muskogee.

• Final Payment to Rosscon, LLC, in the amount of $137,848.14, for Hatbox Site Improvements, Project No. 2022030.

• Letter of Intent to the Opioid Abatement Board to be submitted by City Manager, Mike Miller, for the Political Subdivisions Opioid Abatement Grants Act, in order to be eligible to receive funding from the State Opioid Settlement Fund,.

• City Council Policy 1-13, Matching Grant Fund, in order to provide formal structure, policy and procedures for use of Matching Grant Funds, within the City of Muskogee budget.

• Accept the FY2023-2024 Oklahoma Emergency Management Performance Grant (EMPG), in the amount of $25,000.

• Resolution No. 2956 declaring personal property presently in possession of the City of Muskogee located at 1440 S. Cherokee Street, formerly known as the Agriculture Building, most recently used as the OSU Extension Office building, as described further herein, as surplus to the needs of the City, and authorize the City Manager or his designee, to offer for sale or dispose of the same.

• Amendment to the agreement with Main Street Muskogee for the administration of the Downtown Development Grant.

• Corrected Resolution No. 2954 which was previously listed as Resolution No. 2945 on the August 28, 2023 City Council agenda due to a scrivener’s error.

• Final Payment to Cook Consulting LLC, in the amount of $82,567.81, for the Canterbury Storm Sewer Replacement, Project No. 2022005.

• Final Payment to Daris Contractors LLC, in the amount of $58,884.44, for Raw Water Pump Station, Project No. 2021009.

• Purchase a new rear-load, 10.5 cubic yard sanitation truck, in the amount of $215,910.50, from J and R Equipment via State Contract, Item No. SW0197.

REGULAR AGENDA

• Receive report from Main Street Muskogee regarding their Main Street Muskogee Downtown Grant,.

• Hold a Public Hearing and take action on the approval of Ordinance No. 4200-A to rezone property located at 500 S. 32nd St., from “C-1” Local Commercial, to “C-2,” General Commercial, and if approved, authorize Staff to revise the Official Zoning Map of the City to reflect said change.

• Hold a Public Hearing and take action on the approval of Ordinance No. 4207-A to rezone property located at 3614 W. Okmulgee, from “C-1” Local Commercial, to “C-2” General Commercial, and if approved, authorize Staff to revise the Official Zoning Map of the City to reflect said change.

• Hold a Public Hearing and take action on the approval of Ordinance No. 4208-A to rezone property located at 3103 S. Cherokee, from “R-1” Single Family Residential, to “C-1” Local Commercial, and if approved, authorize Staff to revise the Official Zoning Map of the City to reflect said change.

• Ordinance No. 4205-A for a Franchise Agreement with Cox Communications to provide web-based video services in the City of Muskogee to its commercial customers.

• Ordinance No. 4206-A amending the City of Muskogee Code of Ordinances, Chapter 2, Administration; Article II, Municipal Government Organization, Section 2-29, Citizenship Participation Guidelines and Rules of Decorum; providing for Repealer, Severability, and Setting an Effective Date.

• Joint Resolution No. 2945 between the City of Muskogee (COM) and the Muskogee Redevelopment Authority (MRA), providing for the transfer of the Economic Development program and funds, as well as the transfer of the Civic Center operations management and Enterprise Fund, from the MRA to the COM.

• Resolution No. 2946 amending the Bylaws of the Muskogee Redevelopment Authority.

• Amended Ordinance No. 4198-A, amending Chapter 74, Taxation, Article VIII, Use Tax, by amending Section 74-237, Economic Development Fund, Repealing Section 74-237(g)(1)-(3), removing the Muskogee Redevelopment Authority from managing Economic Development and associated funds for the City of Muskogee, creating a subcommittee, providing for Repealer, Severability and setting an effective date.

• Authorize the City Manager of the City of Muskogee (COM) to execute a letter terminating the November 8, 2021 agreement between the City of Muskogee and the Muskogee Redevelopment Authority (MRA), which transferred management of the Economic Development Program and funds from the COM to the MRA, and waive the ninety (90) days’ notice requirement for immediate termination of the contract, or take other necessary action.

• Authorize the City Manager to negotiate and execute a contract for abatement services between the City of Muskogee and Bee Sure Lawn & Landscape.

• Authorize the City Manager to negotiate and execute a contract for demolition services between the City of Muskogee and FiveStar Demolition.

• Authorize the City Manager to negotiate and execute a contract between the City of Muskogee and Halff Associates Inc, for the completion of the City of Muskogee Comprehensive Plan Update.

• Apply for and if awarded, accept funds from the FEMA Cybersecurity grant for firewall upgrades as a sub-recipient in the amount of up to $40,000, including $4,000 from the matching grant fund.

• Apply for and if awarded, accept funds from the FEMA Cybersecurity Grant for Penetration Testing as a sub-recipient in the amount up to $40,000, including $4,000 from the City’s Matching Grant Fund.

• Final Payment to Vance Brothers, in the amount of $66,468.74, for the Northwest Zone Micro-Surfacing, Project No. 2022008.

• Final Payment to Vance Brothers, in the amount of $25,484.12, for the Southwest Zone Micro-Surfacing, Project No. 2022040.

• Request from Muskogee Public Schools to change the westbound one-way street on Denison Street between 9th and 11th Streets, to an eastbound one-way street on Denison Street from Ninth and 11th Streets.

• Lowest and best bid from Ascend Construction for Grandview Park Improvements, for the base bid amount of $1,383,495.73, with $170,970.64 in alternates, for a total of $1,554,475.37.

• Appointment of Melissa Nissley to the Muskogee City-County Port Authority and Muskogee City-County Trust Port Authority, to serve a four (4) year term, filling the expiring term of Marlon Coleman, beginning October 1, 2023, and ending September 30, 2027.

• Appointment of Darrell Russell to the Muskogee City-County Port Authority and Muskogee City-County Trust Port Authority, to serve a four (4) year term, filling the expired term of Corey Sisson, beginning October 1, 2023, and ending September 30, 2027.

35. Consider an Executive Session to discuss and take possible action on the following:

a. Pursuant to Section 307C.11, Title 25, Oklahoma Statues, consider convening in Executive Session to confer on matters pertaining to economic development, including an incentive request for a potential development in the Southwest quadrant of the City of Muskogee, and if necessary, take appropriate action in Open Session.

b. Pursuant to Section 307 B.1 Title 25, Oklahoma Statutes, consider convening in Executive Session to discuss the terms of employment and evaluate the performance of City Manager, Mike Miller, and if necessary, take appropriate action in Open Session.

c. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in Executive Session to discuss all outstanding litigation involving the City of Muskogee, as per the list, and if necessary, take appropriate action in Open Session.
