They said Barnett wasn’t inside the capitol until after congress was evacuatedThey argue that Barnett walked over to the capitol after former President Trump’s speech at which point, he was swept inside of the capitol when the doors opened, and he couldn’t turn against the crowd. In the court documents, his attorneys write that he wandered into House Speaker Nancy Pelosi’s offices while looking for a restroom and that he left peacefully when asked to do so. Prosecutors said he yelled and cursed at officers escorting him out because he wanted to go back to her office and get the flag he had left behind. He also left a note for Pelosi which included a derogatory wordIt also said in the motion that Barnett’s actions, including putting his feet on the desk, carrying the flag, the anger in his voice and the note he left for Pelosi were all part of political protest. Barnett’s trial was supposed to start on Sept. 6 but was delayed. His new trial date is set for Dec. 12.
